The operator of Airline Reservation System within the www.esky.pl is eSKY Ltd company, located in Radom, Plac JagielloĊ„ski 8.

In order to make use of the Airline Reservation System by means of www.esky.pl one has to accept all the following conditions of the statute. Such acceptance is a declaration of will and constitutes a legal obligation between the User and eSKY Ltd.

The Client is entitled to gratuitous copying, rendering and recording the content of the following statute.

  1. DEFINITIONS

    The Airline Reservation System - programme allowing the User to search for the inland and international flights between any two cities as well as to estimate the cost of such flights and to purchase a flight ticket.

    The User - is any person making use of the Airline Reservation System. The User may be also defined as the Client or the Receiver.

    No-Frill Airlines called hereinafter "Low Cost" airlines consist of the ones mentioned below: Ryan Air, Centralwings, Germanwings, Easy Jet, Virgin Express, WizzAir, Fly I, Sky Europe, Fly Monarch, Kulula, Jet2, Mytravel, Lite, FlyBE, ThompsonFly, BMIbaby, First Choice Airways , Transavia, Excel Airways, Air Southwest, Air Wales, Smart Wings, Loco Flights, FlyGlobespan, Hapag Lloyd Flug, Hapag-Lloyd Express, My Air, Volare, Alpi Eagles, they are not subjects to the general conditions of transport in the IATA regulations. The general conditions of transport are to be found in the 9th paragraph of the present statute.

  2. GENERAL PROVISIONS

    1. Airline Reservation System popularized by eSKY Ltd located in Radom, Plac Jagiellonski 8, with the National Court Registry Number: 0000184679, and with the Tax Identification Number: 948-19-87-199
    2. The following document states the rules that constitute the legal basis for usage of the Airline Reservation System.
    3. Each User when commencing to use the System is obliged to obey the following statute.
  3. USER'S LIABILITY ON THE RESERVATION SYSTEM USAGE

    1. The User confirms that s/he has full legal capacity and is capable of performing legally binding obligations, whereas through accepting the following conditions s/he agrees to take full financial responsibility for the usage of the Reservations System.
    2. The User assures that s/he will be using the System in order to enquire about the reservation and ticket purchase only according to the good law, avoiding any action aimed at enforcing unjust claims.
    3. The User is not allowed to enquire about reservation by means of using false or other people's names as well as to pay for the booked flight tickets with false or someone else's credit card without the consent of its owner.
  4. LIMITATION OF LIABILITY

    eSKY Ltd stipulates that the usage of the System is exclusively at the cost and risk of the User. The company also does not guarantee that the usage will be free of all faults, defects, brakes or connection failure with the System as well as that the result of the search on the Internet will meet Users' demands as far as the essential content, precision or usefulness of the received information is concerned.

  5. PERSONAL DATA SECURITY

    1. eSKY Ltd fully respects Users' law of privacy and personal data security and hereby declares that the information about Users will not be accessible to any third party.
    2. When using the Reservations System offered at www.eSKY.pl the Users will be asked to give certain personal data, indispensable for completing reservation and issuing the ticket correctly. Each times the service of searching for the reservation or purchasing a flight ticket is activated the information about the name, surname, sex and in the case of children, teenagers and senior citizens also the age is sent directly to the reservations system of an airline that operates the flight connections of the User's choice.
    3. While enquiring about the reservation and the purchase of the ticket the User gives his/her personal data. This information which is stored in the eSKY Ltd. data base is used only internally and makes it possible for the company to analyze Clients' orders and demand.
    4. eSKY Ltd will do their best for every User of the Airline Reservations System to have full Access to the new products, services, promotions and price lists offered at www.esky.pl.
    5. Therefore, eSKY Ltd. reserves the right to inform the Users about all promotional campaigns organized by www.esky.pl.
    6. The User is free to opt out from the information service about promotions by means of sending the will of resignation to: rezygnacja@esky.pl.
    7. By means of accepting the following statute the User confirms the authenticity of his/her personal data and in accordance with the 23rd act of personal data security dated on 29.08.1997 agrees for his/her data to be stored and processed in the data base of the Reservations System. The User has the right to have an insight in it and to modify the given information.
  6. MAKING A RESERVATION, TICKET PURCHASE, METHODS OF PAYMENT AND TICKET DELIVERY

    1. Enquiry about a Reserervation

      The User enquires about a reservation by choosing one of the flight route options as well as by filling in a personal questionnaire with all necessary data.

    2. Enquiry and Price Confirmation

      The User receives a confirmation of his/her enquiry at the previously declared e-mail address. The confirmation includes: reservation number, information about a chosen route, total price of the flight ticket and method of payment.

      Ordering and completing a reservation is an obligation for purchasing the flight ticket.

      The price of the flight ticket is stated in the Polish currency - PLN. The price includes: net fare, airport charge and the agency's charge for issuing of the ticket.

    3. Purchase of Flight Ticket
      1. The User can purchase flight ticket provided that s/he has entered authentic personal data into the Reservations System. Before purchasing the flight ticket it is the User's obligation to read the following statute and to accept it as well as to learn about the conditions of payment for a given flight route of the User's choice.
      2. Understanding the conditions that rule the fare will help the User to make the best choice in terms of the price of a given route as well as to minimize the cost of a likely cancellation of the flight ticket.
      3. In order to have the lowest prices for the most flights over Europe it is advisable to make reservations and to purchase the ticket at least two weeks before the planned flight.
      4. The lowest price is for the so called "Sunday Rule" tickets. When using such a ticket one must remember that the return is always on the nearest Sunday after the departure. Departure and arrival can not be made on the same day.
      5. If the stated price differs significantly from the expected one it may be caused by the lack of seats in the cheapest economical classes. You are kindly requested to check the departure and arrival dates within the nearest time.
      6. While traveling beyond Europe it is worth keeping in mind that the price depends greatly on the given season.
      7. Having received the reservation order eSKY Ltd may contact the Client in order to verify his/her personal data and to confirm the offer. Should such contact be impossible eSKY Ltd will not be held responsible for making reservation according to the order.
    4. Methods of payment

      We accept three forms of payment for the flight tickets purchased at www.esky.pl:

      • Credit card
      • Transfer
      • Cash payment in any branch of the BPH (Bank Przemyslowo Handlowy) bank or PKO BP bank, located in Poland or transfer from the account in BPH bank or PKO BP bank to the account previously specified by eSKY Ltd as the most suitable for such transaction.
      • Cash payment in a previously specified eSKY Ltd Office located in Poland.

      User is to choose the preferable method of payment in the personal questionnaire of the Reservations System.

      "Low Cost" tickets can be purchased only by means of the credit card.

      Transfer payments can be made only for the flight tickets reserved at www.esky.pl at least 7-days in advance. When choosing "transfer" as a method of payment the User is obliged to pay eSKY Ltd the stated amount of money for the flight ticket within 24 hours from the reservation order.

      Cash payments and transfer payments are to be made into the account of:

      Transfer must be filled in with the User's (passenger's) name and surname as well as the reservation number. Flight tickets purchased by means of transfer or cash payment are issued by eSKY Ltd on the day on which the due amount for the purchased ticket will be at the above mentioned account.

      Caution! The airlines allow for issuing the ticket within the time no longer than 72 hours since the moment of reservation and within the times no longer than 24 hours in the case of some special fare tickets. Exceeding this term equals to cancellation of User's reservation. eSKY Ltd takes no responsibility for cancellation of Users' reservations that were caused by delays in making payments for eSKY Ltd.

      • Credit Card Payment

        The User of the online airline system of reservations can make the purchase by means of credit card such as: VISA, Eurocard, Mastercard, Diner Club or American Express. Purchasing by means of giving the credit card data is a safe transaction.

        When choosing to pay by means of "credit card" the User is obliged to mark particular space in the personal questionnaire of the Reservations System which define the given credit card (such as: the type, number and expiry date). Having placed the order of the reservation the credit card is being automatically authorized by the Reservations System in the "order by phone" system of eSKY Ltd and charged with the amount due for the purchased flight tickets. Caution! Entering wrong data of the credit card (e.g. wrong number or expiry date) will cause the Reservation System to reject the order.

    5. The Form of the Ticket

      eSKY Ltd stipulates the possibility of changing the form of the paper ticket into the electronic one, in the case when there is a possibility of issuing electronic ticket and the reservations system proved differently.

    6. Delivering electronic flight ticket
      1. Electronic flight tickets purchased at www.esky.pl are delivered at the e-mail address stated in the personal questionnaire of the Reservations System.
    7. Delivery of the flight ticket issued in the paper form
      1. eSKY Ltd delivers flight tickets at the User's expense ordered via www.esky.pl within the time of:
        1. 2 working days within Polish borders
        2. 3 working days all over Europe
        3. 5 working days beyond Europe
      2. Flight tickets purchased at www.esky.pl are delivered by means of "private"letter to the Client at the address specified in the personal questionnaire of the Reservations System as the mail address.
      3. Delivery of the ticket is completed by a DHL courier company (conditions of delivery)
      4. Delivery beyond the terrain of Poland is completed by Courier of Polish Post - "Pocztex" (conditions of delivery)
      5. When ordering the delivery of the flight ticket at the given address User accepts the conditions of delivery of courier companies.
    8. Reservation Annulment Caused by the Carrier

      eSKY Ltd takes no responsibility for any changes or cancellations made by the airlines in the reservations of the System Users. Any information about possible changes in User's reservations will be sent by the eSKY Ltd worker at an e-mail address specified in the personal questionnaire or will be given directly on the phone at the given contact number.

    9. Repayment of the Flight Ticket

      The Client may return the flight ticket purchased at www.esky.pl provided that the return will be completed before the day of departure and if the fare on such ticket renders it possible. When returning the ticket one must remember about the penalty payment which will be deducted from the ticket price (the amount of the penalty payment is defined by the airlines in the conditions of fare and may be even as high as 50% of its original price).

      Some promotional fares do not allow for any changes to be made in the flight ticket or for returning the ticket to the issuer before the departure (resignation from the flight equals loosing the whole amount paid for the ticket).

      The returned ticket must be sent directly to the address of:
      eSKY Ltd 40-061 Katowice, Andrzeja Street 21/7.
      The postal costs for the returning of the tickets to eSKY Ltd are to be held at the Client's cost. It is advisable to send it via registered letter or a courier. Dependably on the method of payment the User's due amount for the returned ticket is sent directly at the User's bank account or at the User's credit card account within 30 days from the day the returned ticket has been received by eSKY Ltd.

    10. Promotional Fares - Limitation of Liability

      Some promotional fares available in the Reservations System www.esky.pl are hedged with certain reservation and ticket issuing conditions. It applies mostly to the fares that must be reserved and purchased in at least 7 and 14 day advance. Not standing by these terms may influence the price of the ticket. eSKY Ltd reserves the right to cancel User's reservation completed exactly 7 or 14 days before the departure in relation with User's exceeding the limit of purchase specified in the conditions of the fare.

  7. COMPLAINTS

    The complaints concerning the reservations and ticket purchase may be placed within 7 days since the day that the ticket in a paper form has been delivered in the eSKY Ltd office, in Katowice, Moniuszki Street 5, or by means of electronic e-mail to the address of: michal@esky.pl

    eSKY Ltd will inform the Client about the acceptance of the complaint and about the time of its investigation within 3 days of its receiving.

  8. FINAL PROVISIONS

    1. eSKY Ltd reserves the right to annulment of the User's reservation and to withdraw from the agreement without giving any causes of such action.
    2. eSKY Ltd reserves the right to one-sided changing of the Statute content. Each Client is obliged to read the Statute before making the reservation and is each time bound with the provisions of the Statute from the day of making reservation and purchasing tickets.

      In the cases not regulated by the present Statute the Civil Code and the Act of 2 March 2000, about the protection of some consumer rights and of responsibility for the damage caused by a dangerous product, are in force (Registry 00, No 22, point 2).

    3. eSKY Ltd will not accept any responsibility for the damage on the Client's part caused by a strike of airline or airport employees or by an act of God resulting in cancellation of the flight.
  9. TRANSPORT STATUTE OF LOW COST AIRLINES:
